How do I become a notary?

    The law no 36/1995, republished, provides that everyone fulfilling the following conditions may become a civil-law notary:

  • a) is a Romanian citizen, a citizen of a member state of the European Union, a citizen from a state of the European Economic Area or a citizen of the Confederation and has his residence in Romania;
  • b) has full legal capacity;
  • c) has a high degree in law;
  • d) has no criminal record resulting from committing an infraction in his activity or in connection with his duties or intentionally committing another infraction;
  • e) enjoys a good reputation, ascertained under the conditions provided in the Statute;
  • f) knows the Romanian language;
  • g) is medically and psychologically able to exercise his position;
  • h) holds for 2 years the quality of notary on probation, he has graduated the Romanian Notarial Institute and promoted the completion exam or has been exercising for at least 6 years a professional legal function and has promoted the contest for the admission in the position of civil-law notary.
    Everyone fulfilling the following conditions may become a notary on probation:
  • a) is a Romanian citizen, a citizen of a member state of the European Union, a citizen from a state of the European Economic Area or a citizen of the Confederation and has his residence in Romania;
  • b) has full legal capacity;
  • c) has a degree in law;
  • d) has no criminal record resulting from committing an infraction in his activity or in connection with his duties or intentionally committing another infraction;
  • e) enjoys a good reputation, ascertained under the conditions provided in the Statute;
  • f) knows the Romanian language;
  • g) is medically and psychologically able to exercise his position;
  • h) has promoted the exam or the contest to acquire the quality of notary on probation, organized by the Steering Committee of the Chamber where he registered himself for the exam or contest.
    The Steering Committees of the Chambers are organizing annually and simultaneously, in a working day, on a date set by the president of the Union, the exam or the contest to acquire the quality of notary on probation.
    The exam or the contest of admission as a notary on probation consists in a written theoretical test, and an oral test, from the methodology approved by the Council of the Union. The minimum grade to promote the exam is 8,00, but not less than 7,00 for each test. The applicants declared admitted will be occupying the positions under a limit approved by the Steering Committee of the Chamber.
    The probation represents the period before acquiring the quality of civil-law notary and it aims to professionally prepare the notary at the beginning of the exercise of profession.
    After promoting the exam or contest the notary on probation follows a 2 years theoretical and practical training organized by the Romanian Notarial Institute.
    During the probation, the notary on probation covers the preparation costs established by the Romanian Notarial Institute. Failing to attend courses or failing to pay the preparation costs leads to the cessation of the quality of notary on probation. The structure of the training and the conditions for applying the penalties provided in this paragraph, but also the procedure for the deployment of the probation are set out by a regulation approved by the Council of the Union.
    The theoretical preparation is carried out by attending the courses organized by the Romanian Notarial Institute. The practical preparation is carried out in a notarial office, assigned by the Steering Committee of the Chamber where the notary on probation sustained the exam or contest to acquire the quality of notary on probation, with the consent of the coordinator notary.
    The activity of a notary on probation can be guided only by civil-law notaries with a seniority of at least 6 years in this quality and who are enjoying a good professional reputation.
    The completion examination consists in two written tests, a theoretical one and a practical one, from the course’s methodology. The minimum average to promote the exam is 8,00, but not less than grade 7,00 for each test.
    After completing the 2 years of probation, the notary on probation is entitled to no more than 2 sessions for the completion exam.
    Failure or, as the case may be, the unjustified absence at two consecutive completion exams leads to the cessation of the quality of notary on probation.
    The person who cumulatively fulfills the following conditions may acquire the quality of civil-law notary:
  • a) is a Romanian citizen, a citizen of another member state of the European Union, a citizen of a state from the European Economic Area or a citizen of the Swiss Confederation and has his residence in Romania;
  • b) has full legal capacity;
  • c) has a degree in law;
  • d) has no criminal records resulting from committing an infraction in his position or in connection with his position or deliberately committing any other infraction;
  • e) enjoys a good reputation, ascertained under the conditions provided by Statute;
  • f) knows the Romania language;
  • g) is medically and psychologically able to exercise the position;
  • h) has at least a 6 years period of seniority in a professional legal position and promotes the contest for admission in the position of civil-law notary organized by the Romanian Notarial Institute (INR)..
    The persons who wish to acquire the quality of civil-law notary, have to register themselves at the Chamber in whose circumscription they want to carry on their activity, for a position proposed by the Chamber and contained in the order for update issued by Ministry of Justice.
    The Romanian Notarial Institute organizes the admission contest at the national level for the persons registered from all the Chambers, at a single time set by the president of the Union, under the conditions provided by the regulation for the organization and functioning of the contest.
    The admission contest consists in two written tests, a theoretical one and a practical one, from the contest’s methodology. The minimum average to promote the contest is 8,00, as long as for each test the minimum grade is 7,00.
    The president of the contest submits, for validation, to the Council of the Union the results for the admission contest.
    The admission contest in the position of civil-law notary for the persons with a least 6 years of seniority in a professional legal position, it is organized by INR, at the request of the Council of the Union, whenever necessary, but at least once every two years.
