Consent of parents about the departure of minor children abroad

    In accordance with the article 30 from the Law no 248/2005, on the free movement of Romanian citizens abroad, border police authorities allow the exit from Romania of minor Romanian citizens only if accompanied by an individual major person, in the following cases:

  • the minor who is the holder of an individual travel document or, where appropriate, an identity card and traveling abroad accompanied by both parents, is allowed to leave on the same terms and together with them
  • the minor who is the holder of an individual travel document or, where appropriate, an identity card and traveling abroad accompanied by one of his parents, is allowed to leave on the same terms and together with this one only if the accompanying parent submits a declaration of the other parent showing his consent about the trip in the destination state or states, but also about the period of the trip or, if applicable, makes proof of the death of the other parent.
  • the minor who is the holder of an individual travel document or, where appropriate, an identity card and traveling abroad accompanied by one his parents is allowed to leave on the same terms and together with this one, without the required declaration of the other parent, only if the accompanying person proves that the minor has been entrusted to him by a final and irrevocable judgment
  • the minor who is the holder of an individual travel document or, where appropriate, an identity card and traveling abroad accompanied by another major natural person is allowed to leave on the same terms and together with this one, only if the accompanying person submits a declaration of both parents or, if applicable, the parent to whom the child was entrusted by a final and irrevocable judgment, of the surviving spouse of his legal representative, which shall comprise their consent about the performance of the trip by the minor, about the destination state or states, about the period of the trip, but also the identification data of the concerned accompanying person.


    In the cases provided by letters b)-d) it is not necessary the declaration of the parent deprived of parental rights or, if applicable, declared lost, under the law, if the accompanying person proves it, excepting the case when both parents are in the same situation, when the declaration of the legal representative of the minor is mandatory.

    This consent, materialized in a declaration given by the parent/ parents before the civil-law notary, must comprise the destination of the trip, the followed route to the destination, the purpose and the period of the trip, but also an indication of whether the child is to remain in the destination, in which case the person to whom the minor is going to be entrusted should be mentioned, or if he is going to return with an accompanying person, whose identification data need to be indicated, if it is a person other than the one with which he exists from Romania.
