    The apostille is a certificate issued by the relevant authorities of a state, signatory of the Hague Convention, for the official documents issued in the concerned country, which will be presented in another signatory state of the Convention.

    The apostille is in fact a stamp which applies to certain documents and stating the authenticity of the signature, quality of the persons signing the documents or, as the case may be, the identity of the seal or of the stamp of that deed.

    The competent authorities to apply the apostille in Romania are the following :

    CHAMBERS OF CIVIL-LAW NOTARIES – starting with 26 of November 2010, they apply the Apostille on notarial deeds drafted by the civil-law notary in compliance with provisions of the Law no 36/1995 (authentic documents, with certain date, with notarization of signature, notarized translations).

    THE PREFECT INSTITUTION – applies the Apostille on the original copy of the following documents:

  • New format of brith certificates, issued after 01.01.1998
  • New format of marriage certificates, issued after 01.01.1998
  • New format of death certificates, issued after 01.01.1998
  • Certificates of criminal record and certificates of car record issued over 6 months ago
  • Certificates of fiscal residence, drawn up both in Romanian and in English, issued by the Public Finance Administrations
  • Certificates attesting the residence, citizenship or legal status to the Romanian state, issued by the National Inspectorate for Persons Record
  • Certificates on the composition of the family issued by the General Directorates for persons’ record
  • Pre-university study documents
  • University study documents
  • Documents attesting the quality of trained in Romania, for foreign citizens
  • Baptize/ wreath certificates previously endorsed by the County Department for Culture, Cults and the National Cultural Heritage
  • Certificates of competency of the crewing maritime personnel endorsed by the Ministry of Transportation and Infrastructure
  • Tourism patents issued by the National Tourism Authority
  • Certificates attesting the work seniority previously covered by the National House of Pensions and Other Social Insurance Rights
  • Certificates of qualifications in different professions previously endorsed by the county agencies for employment, for the certificates issued before 1989, and during the period 1990-2003 and the Municipal Agency for the Employment, Bucharest or the Department of Labor, Social Solidarity and Family, Bucharest

    LAW COURT - applies the Apostille on the following types of deeds:

  • Court judgments
  • Original documents emanating from a bailiff
  • Original documents issued by the Trade Register

    Useful information:

    Signatory countries to the Hague Convention

   List of countries with which Romania concluded bilateral treaties or conventions of legal assistance in civil matters which provide exemption from legalization.
    Extra legalization is a procedure through which it is certified, for the states that do not have the quality of being part of the Hague Convention, with which Romania has bilateral treaties for the the mutual recognition of deeds, the fact that the notarial deed submitted to this procedure is an official deed, authenticity of the signature, the quality of the person signing the document and the identity of the seal or stamp which the deed bears.

    The authorities relevant to extra legalize in Romania are the following :

    MINISTRY OF FOREIGN AFFAIRS – it applies the Extra legalization on the original copies of the following deeds:

  • New format of birth certificates, issued after 01.01.1998
  • New format of marriage certificates, issued after 01.01.1998
  • New format of death certificates, issued after 01.01.1998
  • Certificates of criminal record and certificates of car record issued over 6 months ago
  • Certificates of fiscal residence, drawn up both in Romanian and in English, issued by the Public Finance Administrations
  • Certificates attesting the residence, citizenship or legal status to the Romanian state, issued by the National Inspectorate for Persons Record
